Save Fry-Oil® SMS Program
By accessing or using the Save Fry-Oil® website, mobile application, SMS program, or any related service, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions, along with any other policies referenced herein. SFO reserves the right to update, modify, or replace these terms at any time at its sole discretion. Any changes will be posted on this page with an updated "Last updated" date, and continued use of our services after changes are posted constitutes acceptance of the revised terms. It is your responsibility to review these terms periodically. If you do not agree to the terms as updated, you must stop using our services.
To use our services, you must be at least 18 years of age and have the legal capacity to enter into a binding contract on behalf of yourself or the business you represent. By using our services, you represent and warrant that you meet these requirements. If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify SFO immediately of any unauthorized access or use of your account. SFO reserves the right, at its sole discretion, to refuse service, suspend or terminate accounts, or remove or edit content if we believe a user has violated these terms or engaged in conduct that may harm SFO, its clients, or third parties.
Save Fry Oil® provides fry-oil management products and services for commercial kitchen environments, including but not limited to the Frylow® oil-conditioning device, related accessories, advisory services, and ambassador and referral programs. Product descriptions, specifications, pricing, and availability are subject to change without notice. All products must be installed, operated, cleaned, and maintained in accordance with the instructions and care guidelines provided by SFO. Misuse, improper handling, unauthorized modification, or failure to follow care instructions may void any applicable warranty and may affect product performance. SFO reserves the right to discontinue any product or service at any time without liability to the user.
Any savings figures, performance metrics, ROI calculations, or other results referenced on the SFO website, in marketing materials, case studies, customer testimonials, or related communications are based on real customer experiences and independent third-party testing. However, actual results vary depending on a range of factors, including but not limited to menu items, frying volume, type and quality of fry-oil used, fryer maintenance practices, kitchen hygiene, staff training, and adherence to recommended care procedures. Savings estimates provided to prospective clients are projections only, and SFO does not guarantee any specific outcome, savings amount, or return on investment. Statements regarding food quality improvements, oil-life extension, and operational efficiency are supported by customer reports and independent testing but should not be interpreted as a guarantee.
All content available through the Save Fry-Oil® website, mobile application, SMS program, and related materials — including but not limited to text, graphics, logos, icons, images, photographs, audio, video, software, trademarks, trade names, and trade dress (including "Save Fry Oil," "Frylow," "FryWise™," "FryCaddy," and related marks) — is the property of Save Fry Oil®, its affiliates, or its licensors and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use our services for personal or internal business purposes only. You may not copy, reproduce, distribute, modify, publish, display, transmit, sell, license, or create derivative works from any part of our content without prior written permission from SFO. Any unauthorized use terminates the license granted herein.
When using our services, you agree not to: (a) use the website, app, or SMS program for any unlawful, fraudulent, or harmful purpose; (b) transmit viruses, malware, spam, or any other malicious or harmful code; (c) attempt to gain unauthorized access to SFO's systems, servers, accounts, or networks; (d) interfere with, disrupt, or impose an unreasonable load on our infrastructure; (e) impersonate any person or entity or misrepresent your affiliation with any person or entity; (f) harvest, scrape, or collect data from our services without permission; (g) use our services to harass, abuse, threaten, or defame any person; or (h) violate any applicable local, national, or international law or regulation. SFO reserves the right to investigate suspected violations and to take appropriate action, including reporting to law enforcement and pursuing legal remedies.
The Save Fry-Oil® website, mobile application, SMS program, and any related content or services are provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, statutory, or otherwise. To the fullest extent permitted by law, SFO disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. SFO does not warrant that our services will be uninterrupted, timely, secure, error-free, or free of viruses or other harmful components, or that any defects will be corrected. Any product-specific warranties, where applicable, are governed separately by the warranty terms accompanying the product (such as the Frylow® 5-year warranty) and are subject to the conditions outlined therein. No advice or information obtained from SFO or through our services creates any warranty not expressly stated in these terms.
To the maximum extent permitted by applicable law, in no event shall Save Fry Oil®, its affiliates, officers, directors, employees, agents, suppliers, or licensors be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to loss of profits, revenue, data, business opportunity, goodwill, or other intangible losses, arising out of or in connection with your use of, or inability to use, the website, app, SMS program, products, or services, regardless of the legal theory on which the claim is based and even if SFO has been advised of the possibility of such damages. SFO's total aggregate liability for any claim arising out of or related to these terms shall not exceed the total amount paid by the user to SFO for the relevant product or service during the twelve (12) months immediately preceding the event giving rise to the claim. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
You agree to indemnify, defend, and hold harmless Save Fry Oil®, its affiliates, and their respective officers, directors, employees, agents, and licensors from and against any and all claims, demands, actions, damages, losses, liabilities, judgments, settlements, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use or misuse of our website, app, SMS program, products, or services; (b) your breach or alleged breach of these Terms and Conditions; (c) your violation of any law, regulation, or third-party right (including any intellectual property right or privacy right); (d) any content you submit, post, or transmit through our services; or (e) any negligent or wrongful act or omission by you. SFO reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you agree to cooperate with SFO's defense of such claim.
Our website, app, and SMS messages may contain links to third-party websites, products, or services that are not owned or controlled by Save Fry Oil®. SFO has no control over, and assumes no responsibility for, the content, privacy policies, business practices, or actions of any third-party websites or services. You acknowledge and agree that SFO shall not be liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any third-party website or service. We strongly encourage you to read the terms of use and privacy policies of any third-party website or service you visit before providing any personal information or making any purchase.
These Terms and Conditions, and any dispute arising out of or relating to them or your use of our services, shall be governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to its conflict-of-law principles. You agree that any legal action or proceeding arising out of or relating to these terms shall be brought exclusively in the courts located in Victoria, British Columbia, Canada, and you consent to the personal jurisdiction of such courts. Before pursuing formal legal action, the parties agree to first attempt in good faith to resolve any dispute through informal negotiation by contacting SFO via our Contact Us page. If the dispute cannot be resolved within thirty (30) days of written notice, either party may proceed with formal proceedings. This clause does not prevent SFO from seeking injunctive or equitable relief in any court of competent jurisdiction to protect its intellectual property or confidential information.
